KNOW THE CHARGES AGAINST RAJ KUNDRA 1

Recently, Raj Kundra one of the famous businessman was arrested by Mumbai Police for being a prime accused in producing the pornography contents. Raj Kundra is a British Indian businessman. He was ranked as the 198th richest British Asian by Success in 2004. His father, B.K. Kundra was a middle-class businessman. Kundra has had various investment interests, including IPL and martial arts. He has been married to Shilpa Shetty, a Bollywood actress, since 2009.

In the FIR (First Information Report) filed by the Mumbai Police, following charges has been made against him:-

  1. Section 420 of Indian Penal Code: This Section states that whoever cheats and thereby dishonestly induces the person deceived to deliver any property to any person or destroy or alter any valuable security which is capable of being converted into a valuable security. The punishment under this Section is upto 7 years and fine.
  2. Section 34 of Indian Penal Code: This Section talks about Common Intention of several person in committing any particular offence. Example: A,B,C & D plans to murder E. Here A,B, C & D have common intention.
  3. Section 292 of Indian Penal Code: This Section talks about Selling, distributing, publishing etc. Of obscene books, pamphlet, paper, writing, drawing, figure or any other object. The punishment under this Section may extend upto 2 years and fine of Rs. 2000/-.
  4. Section 293 of Indian Penal Code: This Section talks about Selling, distributing, publishing etc. Of obscene objects to young person (under the age of 20 years). The punishment under this Section may extend upto 3 years and fine of Rs. 2000/-.
  5. Section 67 Information Technology Act: This Section talks about punishment to the person who publishes or transmits or causes to be published in electronic form, any obscene material which is lascivious or deprave and corrupt persons. The punishment under this Section may extend upto 3 years and fine may be extended to Rs. 5,00,000/-.
  6. Section 67A Information Technology Act: This Section talks about punishment to the person who publishes or transmits of material containing sexually explicit act, etc., in electronic form. The punishment under this Section may extend up to 5 years and fine may be extended to Rs. 10,00,000/-.
  7. Other relevant Sections of Indecent Representation of Women Act: Raj Kundra is accused of being involved in the indecent representation of women in form of producing, publishing etc of pornography contents. Therefore, any such involvement is subjected to legal punishment under this Act.
