Epidemic Diseases Act 1897: Attack on healthcare workers to be cognizable and non-bailable

On 22nd April 2020, Government of India has promulgated ordinance to amend the Epidemic Diseases Act 1897 to fight against the pandemic of Covid-19.
As per this ordinance 3 major amendments are made for the protection of whole healthcare fraternity:
1. If any attack is done on the health care workers (including doctors, paramedic staff, nurses, asha workers etc) then it will be cognizable and non-bailable offence. Further, imprisonment of 3 months which may extend upto 5years or fine of ₹50,000 to ₹2,00,000.



2. As a result of such attack, if any grave or serious injury is caused to health care workers (including doctors, paramedic staff, nurses, asha workers etc) then it will be congizable and non-bailable offence. Further, imprisonment of 6 months which may extend upto 7 years or fine of ₹1,00,000 to ₹5,00,000.

3. If any destruction or loss is caused to personal vehicle or clinic of that health worker then compensation amounting to twice the market value of the damaged property will be recovered  from the accused.(income/property)

4. The ordinance proposes that in case of attack on healthcare workers, the investigation will be completed within 30 days and final decision of the case shall be arrived within one year.
